This suit was commenced on September 7, 1933, in the circuit court for Wayne county, Mich., by appellant, William F. Connolly, a resident and citizen of Michigan and receiver by appointment of a state court of Detroit Bankers Company, a Michigan corporation, against First National Bank-Detroit, a national banking association, and C. O. Thomas, its receiver, appointed by the Comptroller of the Currency, to recover $7,000,000, which, appellant alleged, the Bankers Company had advanced to the First National Company of Detroit in payment of the banks indebtedness thereto.
