On June 6, 1970, a jury found Larry C. Champlain guilty of armed robbery, theft, and burglary (secs. 943.32 (1) and (2), 943.20 (1) (a), (3) (d), and 943.10 (1) (a), Stats.). He was sentenced to an indeterminate term not exceeding ten years in prison for the armed robbery and five years each for theft and burglary to run concurrently with the armed robbery term. The court denied a motion for judgment of acquittal notwithstanding the verdict and in the alternative for a new trial. Champlain appeals from that order.
